Terms and Conditions of Event Booking – Roof Terrace
1. Confirmation of Booking
1.1 Bookings will only be regarded as confirmed upon receipt of full payment of the deposit (see section 2 for further details of the deposit). On payment of your deposit, you will be deemed to have accepted these Terms and Conditions. The booking shall then come into effect and the agreement between you and Rockwater shall come into existence and be binding on both parties.
1.2 Any changes to the booking details must be made in writing and will be of no effect unless acknowledged in writing by Rockwater.
1.3 In the event that the booking form is signed in the name of a company, partnership, agency, firm club or similar society, the person signing represents to Rockwater that they have full authority to sign such a contract. In the event that they are not so authorised they will be personally liable for the complete performance of this contract.
2. Minimum Spend and Deposit
Minimum spend
2.1 The minimum spend for event bookings is £50 per person, for 12 or more guests.
2.2 The minimum spend applicable to your booking will be as set out in the booking form sent to you. This will include VAT at the prevailing rate but will exclude the discretionary service charge of 10% which is added to your final bill.
2.3 If you meet the minimum spend, your deposit will be redeemed against your final bill.
2.4 If the minimum spend is not met, then deposit monies will be retained to the value of the shortfall against the agreed minimum spend.
Deposit
2.5 A deposit of £20 per person is required for bookings with 12 or more guests. A link to make payment of the deposit will be sent to you with the booking form.
2.6 The deposit will be redeemed against your final bill if the minimum spend is met (see sections 2.3 and 2.4).
2.7 Your deposit must be paid within 7 days of when we send your booking form. Rockwater reserves the right to cancel any provisional event booking should the deposit payment not be paid by the date requested.
3. Final Numbers
3.1 Guest numbers for your event are required to be provided in the booking form we send you.
3.2 Any amendments to guest numbers must be confirmed in writing at least 7 working days prior to the event taking place. These are the minimum guest numbers for which you will be charged.
3.2 Rockwater reserves the right to charge for the full number of people booked if we have not been provided with notice of the reduction in numbers.
3.3 Rockwater will make reasonable endeavours to accommodate any increase in numbers and will charge accordingly for providing this service, but cannot be held responsible for failure to provide such accommodation or service.
4. Pre-Orders
For event bookings for 12 or more guests, we require you to submit your pre-order for food no later than 7 days prior to the date of your event. Pre-orders for drinks are not required but are welcomed. Rockwater will endeavour to meet drinks requirements at your event but this is subject to availability of stock where pre-orders have not been submitted.
5. Cancellation by the Customer
5.1 Should you need to cancel your booking, please let us know as soon as possible. Any cancellation made by you must be in writing to Rockwater and formally acknowledged in writing by Rockwater.
5.2 In the event of cancellation by you, Rockwater shall be entitled to cancellation charges as detailed below:
(i) 0 – 14 days prior to the commencement of the event, the cancellation fee will be 100% of the total minimum spend for your event;
(ii) 15 – 30 days prior to the commencement of the event, the cancellation fee will be 100% of the deposit paid for your event; and
(iii) 31 days or more prior to the commencement of the Event, no cancellation fee will apply.
5.3 If you wish to reschedule your event, provided you give us no less than 15 days’ notice of such change, no fee will be payable and your deposit will be transferred to the new event date. Where less than 15 days’ notice is provided, the rescheduling fee will be 100% of the deposit paid for the original date of your event.
6. Cancellation by Rockwater
6.1 Rockwater shall be entitled to cancel your booking and shall not be liable for any failure or delay in performing its obligations under this agreement where that failure or delay results from any cause that is beyond Rockwater’s reasonable control. Such causes include, but are not limited to: power failure, strikes, lock-outs or other industrial action by third parties, terrorism, riots and other civil unrest, fire, explosion, flood, storms, epidemic or other natural disaster, or any other event outside Rockwater’s reasonable control.
6.2 Rockwater shall be entitled to cancel your booking if you are in breach of any of the terms and conditions.
7. Prices
7.1 A 10% discretionary service charge will be added to the final bill, however, payment of this remains at your discretion.
7.2 By signing the booking form and paying your deposit you have acknowledged and accepted these terms and conditions and therefore agree to the minimum spend quoted, which includes VAT at the prevailing rate and is exclusive of service charge.
7.3 Rockwater reserves the right to charge in full for anything removed and/or damaged from Rockwater by guests at your event.
7.4 All prices are current at the time of going to print and included vat or other government taxes where appropriate. Rockwater reserves the right to amend prices and take into account any charges in the rate of vat and other taxes.
8. Signage & Decorations
No decorations, flags, emblems, signs, displays, posters, placards, advertisements, notices or other accessories shall be displayed or used by you on the premises without the prior written consent of Rockwater. Such consent must be obtained no later than 7 working days prior to the date of your event.
9. Third Party Suppliers
Rockwater has a preferred list of third party suppliers for events features including (but not limited to) entertainment, flowers and specialist hire equipment. Use of suppliers outside of this list are subject to the prior written consent of Rockwater. Such consent must be obtained no later than 14 working days prior to the date of your event.
10. Loss or Damage
10.1 Rockwater will not be liable to you or any guest at your event for any loss of or damage to clothing, equipment or any other such property.
10.2 You agree to be responsible for and indemnify Rockwater against all damage to the property of Rockwater caused by an act, default or negligence on the part of you or any guest at your event.
10.3 Nothing in these terms and conditions shall operate to exclude or limit the liability of Rockwater for death or personal injury caused by its negligence.
11. Governing Law
These terms and conditions, together with the booking form, constitute your agreement with us and shall be governed by the laws of England and English courts shall have exclusive jurisdiction to hear and determine any dispute, action or claim that may arise out of or in connection with it.
